What happens if you are injured or become ill and cannot communicate and you do not have an up-to-date financial power of attorney document in place(identifying someone to handle your financial affairs) or a healthcare power of attorney document (naming individuals to make healthcare decisions for you? Your loved ones may have no choice but to engage an attorney to have the court appoint a guardian for your property and a guardian for your person. Such proceedings are expensive and time-consuming. A guardian appointed by the court must file an annual report of your financial holdings and expenditures during the year and an annual report on your healthcare condition. I have represented families in this situation and have advised guardians on preparation and filing of such annual reports.
